INCOME TAX FILING FOR POOR DEFENCE PENSIONERS

This is the first time a Sepoy pensioner of the Indian Army has to run from pillar to post for filing income tax return just because some banks have deducted huge amount of tax from their pension.  The amount of tax deducted is not proportionate to their income.  In some cases some banks like Indian bank deducted 90% of the pension as tax for three consequtive months from Jan 2017 and paid only 10 % pension.

On our complaint to the Banks, they simply replied to file IT return and get refund if any.

A 75 years old Sepoy's total pension income including all arrears was only Rs.3,45,000.  The bank had deducted Rs.40,000 as tax even after submitting PAN card to the bank.  There are many similar cases.  If a proper help is given to these pensioners for filing IT return with 10E, they will get the entire tax deducted as refund.  But we find it very difficult to educate them on this subject.  Most of them are ready to forego the entire amount deducted than running around here and there for IT filing.

However, the Exwel Trust conducted meeting exclusively for this purpose and explained in detail.  But the response is not encouraging.  Many aged pensioners do not have PAN Card.  There is no one to help them to get one.  They have to run a number of times to bank to get Form 16 and statement of account etc. from bank.  Most of the pensioners do not have old pass books to note down their pension received from 2006 to 2017 for claiming relief under Sec.89(1).  Banks are not giving statement of account from 2006.  Some learned people are afraid of disclosing their 2nd pension for the sake of refund.  Likewise there are so many reasons.

THIS IS THE ATTITUDE OF MOST OF THE DEFENCE (ARMY PENSIONERS).

As far as possible, we are helping all the pensioners who are approaching for filing tax and helping them to get refund.

The last day for filing tax return is 31st July 2017.  We will accept application for filing tax up to 20.07.2017 only.

Applications coming after 20.07.2017 will be returned.  The money orders also will be returned.  (We expect a donation of Rs.800 for Filing 10E and filing IT return).  Those who want to send application for filing income tax must send the following details ina neatly typed format.  All documents must be sent by Courier or Speed post only.  One or two documents only will be accepted by email/scanning etc.  We will not accept the entire documents by email.  Please note to send the following information in proper form and help us to help you.

The particulars of a Pensioner.

1. Name, Address, Mobile No. and Date of Birth.

2. Father's Name.

3. PAN Card No. and xerox copy.

4. Aadhaar Card No. and copy.

5. For 16 issued by bank both Part A and B.

6. Copy of bank pass book front page and transactions from Mar 2016 to Mar 2017.

7. If you are drawing two pensions, the details of 2nd pension from 2005 to 2017 (Yearwise total from Apr to Mar of each year)

8. Detaials of arrears received.

a) OROP arrears each instalment and date paid.

b) Delinking arrears amount and date paid.

c) 7 CPC arrears and date paid.

9. Your service particulars are most important.

a) Rank

b) Total service.

c) Group

d) Date of retirement

e) Present basic pension.

Bank details

a) Name of bank, Branch, IFSC Code with pass book front page copy.

b) Account No.

Note: Please note down the total tax deducted from the pass book for the FY 2016-17 and see that it is correct with the Form 16.  If there is any difference, please get a corrected F.16 from bank and send.

FILING OF 10E FOR OFFICERS

All prematurely retired officers (Those who have retired before completing 28 years) were paid Delinking arrears as per CDA Cir.568.

The tax deducted on these arrears is increased proportional to the amount of arrears paid.  Since the arrears were accrued from 2006 and paid now there is good scope of claiming tax relief u/s 89 by filing 10E before filing tax return.  A Lt. Col with 22 years service getting 6.5 lac delinking arrears will get around 1.25 lac tax relief u/s 89.  The following information is required to file 10E.

1. Financial year wise pension income from 2005 to 2017.

2. Year wise breakup of delinking arrears received.

The above information can be obtained from bank.  An officer who has paid tax regularly from 2005 can make use of his Tax return copy for recording the pension income from 2005.

An officer, who has not filed tax so far can also file 10E and claim relief.   All pensioners must insist the bank to issue pension statement from 2005.  Also they have to obtain delinking arrears working sheet from bank to prepare break up from 2005.  This is the situation regarding income tax for officers this year.  Those who want any help may contact Exwel Trust.

Fincncial year wise pension income from 2005 to 2017 and year wise break of the DL 33 arrears are a must for claiming relief u/s 89.  If there is a will, there is a way.  nothing is impossible.

CONDITIONS FOR CLAIMING INCOME TAX RELIEF U/S 89

AND FILING FORM 10E

1. There is no necessity to file all previous years returns for claiming relief u/s 89.

2. The relief u/s 89 is to be given in the assessment in which the extra payment by way of arrears, advance extra is taxed.

3. Basically, the relief u/s 89 is arithmetical.

4. It involves finding out two rates of tax.  The first is the rate of tax applicable to the total income including the extra amount in the year of receipt.  The second is finding out the rate by adding the arrears to the total income of the years to which they relate.

5. For this purpose, the assessee should be asked for a true and authentic statement of the total income of the earlier years to which the arrears pertain.

6. There is no warrant for issuing a notice u/s 148 or calling for returns of income of the earlier years.

Note: Many Defence pensioners (specially reemployed and retired) who have received DL 33 arrears are hesitating to claim relief because of the fear that they will be asked to file IT Return for the previous years.  This clarification is given to clear their doubts.  They can file IT return for the First time and claim relief without any fear.

Since most of the banks are not giving the working sheet and yearwise break for

the Delinking arrears, the Chartered Accountants are finding it difficult to file Form 10E

for the defence pensioners.

Banks have deducted Income tax to most of the Defence pensioners because of the payment of Delinking arrears, 7 CPC arrears and OROP instalments.

Many low paid pensioners such as Sepoy, Naik and Havildars can get refund, if they file Form, 10E and IT Return in time.

Now that most of the banks have paid the arrears and revised pension.  Some banks have deducted Income Tax for the arrears paid.  

Please submit your PAN Number to the bank and get Form 16 for the Tax deducted.

Also collect pension statement from April 2016 to March 2017 and calculate your tax.  All Sepoys, Naiks and Havildars will get refund of the Tax paid now if they file Form 10E with the help of an Auditor and claim IT relief and refund.  This is very important. 

The family pensioners whose husbands died after 1.1.2006 are eligible for

delinking arrears.  Some banks pay automatically.  But most of the banks

do not pay.  Now the family pensioner has to submit a claim for LTA along with

copy of PPO, Death certificate and the delinking calculation to the CPPC of their Bank.
